If you do not agree, you must cease use of the Site and refrain from purchasing services.
1. General Acceptance & Agreement
These Terms constitute the complete agreement between you and Sky Rivers ("we," "us," or "our") concerning your access to the Site and the acquisition of our Services.
- 1.1 Governing Law and Jurisdiction: These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any dispute arising out of or in connection with the Site or Services shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
- 1.2 Changes to Terms: Sky Rivers reserves the right to review and change these Terms at any time by updating this page. Any changes take immediate effect from the date of their publication. Your continued use of the Site and Services after such changes means you accept the modified Terms.
2. Intellectual Property & Use
- 2.1 Site Intellectual Property: All content on the Site, including text, graphics, logos, images, and the compilation of the Site itself, is owned by Sky Rivers and protected by Australian and international copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from the Site's content without Sky Rivers' written permission.
- 2.2 Proprietary Frameworks: All proprietary frameworks, teachings, exercises, written program materials, and methodologies, specifically including The Actuality Method™, are the exclusive intellectual property of Sky Rivers. You are granted a limited, non-transferable license to use these materials for your own personal, non-commercial development through your use of the Site, sessions, or programs. You are strictly prohibited from copying, adapting, redistributing, or teaching these frameworks to others, or using them as part of your own commercial offerings.
- 2.3 Music & Audio Intellectual Property: All music files, audio transmissions, guided recordings, and digital audio content produced by Sky Rivers are protected by international copyright laws. Your access, streaming, or purchase of any audio content grants you a limited, non-exclusive license for personal, private listening only. You may not:
- Record, reproduce, distribute, or publish any part of live audio sessions, workshops, or digital audio content.
- Share, copy, or sell any music files or audio transmissions.
- Use the music or audio recordings for any commercial purposes (including as background audio for your own videos, podcasts, classes, workshops, or digital products) without a separate commercial license from Sky Rivers.
3. Terms Governing Sessions, Programs & Workshops
These terms apply to all sessions, activations, programs, and workshops provided by Sky Rivers.
- 3.1 Access and Registration: Access to Services is provided via the booking systems on the Site (Cal.com, Patreon, and Kit). All sessions and workshops are hosted securely via Zoom or in-person venues. Access links are automatically generated and granted upon successful payment and confirmation of scheduled dates.
- 3.2 Fees and Payments: Fees are specified at the time of booking or as outlined in your personalised program invoice. All fees are processed securely through third-party payment gateways (Stripe). By purchasing the service, you agree to their respective terms.
- 3.3 Private 1:1 Sessions & Programs (e.g., The Kundalini Mentorship):
- Single Sessions: Payment is due in full at the time of booking. You must provide at least 48 hours’ notice if you need to reschedule. Sessions missed, or cancelled by you with less than 48 hours’ notice, are entirely forfeited and will not be rescheduled or refunded.
- Multi-Week Programs: Entry into dedicated programs (such as The Kundalini Mentorship) is by mutual alignment. Payment is due in full upfront prior to commencement or as agreed per instalment schedules. To protect operational scheduling and the depth of the energetic container, program fees are non-refundable once paid, and early termination is not permitted. Subsequent monthly extensions are billed on an agreed basis and can be cancelled with a minimum of 7 days' notice prior to the next billing date.
- Presence & Recording Policy: To honour the sacred container, sessions are not recorded, and recording by participants is strictly prohibited. Because this work is experiential and unfolding in real time, no audio or visual playbacks are provided.
- Late Arrival: If you arrive late to a session, the session will still end at the scheduled time to respect subsequent bookings. Lost time will not be made up.
- 3.4 Group Sessions & Workshops: Because group capacity is strictly capped to maintain presence and physical/energetic safety, tickets are non-refundable. If you cannot attend a live session or workshop, you may transfer your ticket to another person, provided you notify us via our Contact form at least 24 hours before the event begins.
4. General Legal Provisions
- 4.1 Somatic & Energetic Disclaimer: Use of the Services is at your own risk. The information and guidance provided are for energetic inquiry, spiritual exploration, and personal development only, and are provided "as is" without warranty. Sky Rivers is a Master Practitioner of energetic disciplines, not a medical doctor, psychiatrist, licensed financial advisor, or mental health counsellor. Our sessions, music, and frameworks are designed to connect with the body's intelligence and do not substitute for clinical medical or psychological treatment. You acknowledge that you remain fully responsible for your own physical, mental, and emotional well-being, choices, actions, and results.
- 4.2 Limitation of Liability: To the extent permitted by law, Sky Rivers will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site or Services. Total liability will not exceed the resupply of the Service or the cost of the session/program to you.
- 4.3 Indemnity: You agree to indemnify and hold harmless Sky Rivers from and against all actions, claims, demands, and expenses arising out of your breach of these Terms or your use of the Site and Services.
- 4.4 Competitors: If you are in the business of providing similar energetic, energy medicine, or transformational services for commercial gain, you are considered a Competitor. Competitors are not permitted to use or access proprietary exercises, music, frameworks, or content on this Website for commercial reproduction or adaptation.
- 4.5 Privacy: Your use of the Site and Services is also governed by our Privacy Policy.
- 4.6 Severability: If any part of these Terms is found to be void or unenforceable, that part shall be severed, and the rest of the Terms will remain in full force and effect.
